Healthcare compliance assessment

HIPAA risk assessment, run within the engagement with authorized access.

A HIPAA risk assessment inside the target needs authorized access and appropriate BAA arrangements.

A HIPAA risk assessment examines risks to electronic protected health information within an agreed engagement. Meo Advisors needs authorized access to the target’s records, systems and responsible teams, with appropriate BAA arrangements before review. Public pages cannot establish internal safeguards. Findings and open questions inform remediation. Not legal advice; legal questions go to counsel.

In short

  • A HIPAA risk assessment inside the target needs authorized access and an agreed evidence scope.
  • Agree the BAA and data-handling arrangements before reviewing protected health information.
  • Not legal advice. Legal questions go to counsel, including conclusions about HIPAA obligations.

What is a HIPAA risk assessment?

A HIPAA risk assessment examines potential risks and vulnerabilities to the confidentiality, integrity and availability of electronic protected health information. Within diligence, Meo scopes this review inside an authorized engagement; a public website review cannot establish the condition of the target’s internal safeguards.

A HIPAA risk assessment is a documented review of risks and vulnerabilities to electronic protected health information, used to inform safeguards and risk management.

HHS risk analysis guidance explains the scope and ongoing nature of the review. Legal reference, not legal advice. The compliance due diligence hub explains how legal questions are flagged for counsel.

Insured for cyber, general and professional liability. BAAs in place as needed. HIPAA audits available.

What is security risk analysis?

Security risk analysis identifies where electronic protected health information is held, the threats and vulnerabilities affecting it, and the likelihood and impact of potential harm. The analysis supports a documented risk-management response; it is not satisfied by checking a public website or collecting policy titles alone.

The review needs evidence of systems, information flows, safeguards and how controls operate. Each supported finding receives an owner; missing records remain open questions with the evidence needed to resolve them.

What can trigger a HIPAA compliance audit?

A complaint or reported breach can lead to an OCR investigation or compliance review. Selection for the federal audit program is a separate route. Those processes should be distinguished from a voluntary risk assessment commissioned during a transaction.

HHS describes OCR’s enforcement process and its HIPAA audit program. Counsel should handle regulator correspondence, legal questions and the response to any reported incident. Not legal advice.

How often are HIPAA audits done?

Federal audit selection and a company’s own risk analysis are different processes. There is no universal schedule promising when a target will receive a federal audit. HHS describes risk analysis as ongoing, with updates as circumstances change, rather than a fixed interval that fits every organization.

Agree review triggers around system changes, incidents, ownership changes and new information flows. Counsel should confirm applicable obligations, while the operating team assigns owners for maintaining the evidence and remediation record.

Can a HIPAA audit be part of an acquisition review?

Yes. A scoped HIPAA risk assessment can run within an acquisition engagement when the target authorizes the work and the required BAA and data-handling arrangements are in place. Keep that internal assessment distinct from passive public observations and record any access limits in the readout.

The healthcare due diligence hub sets the wider transaction context. Use healthcare technology due diligence for systems and integration questions that sit alongside the risk assessment.

What needs authorization before the assessment starts?

Access to internal systems, control records, staff interviews and protected health information requires the target’s authorization and an agreed scope. Set the BAA, permitted data, storage, reviewers and deletion arrangements before evidence collection begins.

  • Identify the responsible company contacts and the systems and information flows in scope.
  • Agree the BAA and required data-handling arrangements before reviewing protected health information.
  • Request evidence through approved channels and limit collection to the agreed review.
  • Keep public observations, authorized findings and unresolved evidence requests distinct.

An internet-facing page does not authorize internal access, scanning, login attempts or testing. Any active security testing needs its own written authorization and permitted activity.

How should the deal team use healthcare breach-cost context?

An industry breach-cost benchmark provides context for the importance of healthcare information security. It does not estimate a target’s loss, predict a breach or establish the financial return from a risk assessment.

Transaction decisions should use the target’s supported findings and unresolved questions. A benchmark cannot substitute for evidence of its controls, contracts or response capability.

What does the HIPAA risk assessment deliver?

The assessment delivers the agreed evidence record, a prioritized risk register and an action plan with owners and verification steps. It identifies scope limits and open questions so the sponsor can see what has been examined and what still needs access or counsel’s review.

Illustrative mock; no engagement data. The full register adds evidence and a counsel flag for each risk. As of October 2026.
  1. Agree the decision, systems, authorization and evidence-handling requirements.
  2. Map information flows and review the authorized safeguard evidence.
  3. Document risks and open questions, with legal questions sent to counsel.
  4. Assign remediation owners and the evidence needed to verify completion.

The register above is illustrative. The sample diligence deliverables show the reporting format; a completed engagement is not a guarantee of compliance.
